1. Acceptance of Terms

By downloading, installing, accessing, or using SatUP! (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App after any changes constitutes acceptance of the modified Terms.

2. Description of Service

SatUP! is a gamified SAT preparation mobile application that provides:

• Practice questions and quizzes
• Progress tracking and analytics
• Gamification features (XP, achievements, streaks)
• Leaderboards (global and private)
• SAT score predictions and history

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time without notice.

3. User Accounts

3.1 Account Creation

You may create an account to use certain features of the App. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete information

3.2 Account Security

You must immediately notify us of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

4. Acceptable Use

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's operation
• Use automated systems (bots, scrapers) to access the App
• Impersonate any person or entity
• Harass, abuse, or harm other users
• Share or distribute content that is offensive, defamatory, or violates others' rights
• Attempt to manipulate leaderboards, scores, or achievements through fraudulent means

5. Intellectual Property

5.1 Our Content

The App, including its design, features, content, and functionality, is owned by Silly Monkey Studios and protected by copyright, trademark, and other intellectual property laws.

5.2 Your Content

You retain ownership of any content you create or submit through the App. By using the App, you grant us a license to use, store, and display your content as necessary to provide the App's services.

5.3 Third-Party Content

SAT questions and content may be sourced from third parties. All such content remains the property of its respective owners.

6. Leaderboards and Social Features

The App includes public and private leaderboards. By participating:

• Your username, scores, and rankings may be visible to other users
• You consent to the public display of your progress data on leaderboards
• You are responsible for your interactions with other users
• We reserve the right to remove users from leaderboards for violations of these Terms

7. Disclaimers

7.1 Educational Content

While SatUP! is designed to help with SAT preparation, we make no guarantees about:

• The accuracy of score predictions or calculations
• Improvement in actual SAT scores
• The completeness or accuracy of educational content

7.2 Service Availability

The App is provided "as is" and "as available." We do not guarantee that the App will be:

• Uninterrupted or error-free
• Free from viruses or harmful components
• Available at all times

8. Limitation of Liability

To the maximum extent permitted by law, Silly Monkey Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:

• Loss of data or progress
• Loss of profits or revenue
• Interruption of service
• Any damages resulting from use or inability to use the App

Our total liability shall not exceed the amount you paid to use the App (if any) in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Silly Monkey Studios from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party

10. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity

Upon termination, your right to use the App will cease immediately. We may delete your account and associated data, subject to our Privacy Policy.

11. Age Requirements

SatUP! is designed for users age 4 and up. If you are under 18, you represent that you have your parent's or guardian's permission to use the App and agree to these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Silly Monkey Studios operates, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law. You waive your right to participate in a class-action lawsuit or class-wide arbitration.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Silly Monkey Studios regarding the App and supersede all prior agreements.
